Only some lame fuck would do that. I'm sure they would feel terrible and the feeling of knowing you fucked up that bad is probably tremendous.

But my sympathy is for the person who cant defend themself.

If I did that to my kid I would shoot myself in the head. I suggest others try it

but the direct question is whether you think this should be handled in the criminal courts?
Does putting a mother in jail who accidentally killed their child in this way prevent it from happening? Does it act as a deterrent? Does it prevent it from happening again from the same mother at a greater rate than it would happen anyway?

The point of the justice is not to create a deterrent.

Yes courts
It may help it from happening to others. When I see the stories I play over the scenarios in my head of how it could happen. Changed schedule being the most likely imo.

Even if its accidental your still liable imo. Not for 1st degree murder but definitely manslaughter. I think the jury is the one who should get to decide ultimately and they may find them not guilty depending on the situation.

I agree. I'm just running the synopsis of considerations that people have raised in this thread about how one determines whether the criminal courts should be used in any situation.
Adding to that list of incomplete questions, does the victim need justice in this case? Is that obtained through the criminal court? Does the victim's family demand that Justice?

I wouldn't go that far, but I'm in the camp that most of these mothers killing their kids are an accident that should not be legally punished.
I'm sure it's an accident 98% of the time.

But if you accidentally gave someone the wrong meds and they died would you be liable if it was proven to be 100% your negligence?
