This is circular logic you're running now.
The supreme Court interprets the laws. Rights are granted by our creator and specified in the Constitution for our reading.
The supreme court interprets whether laws violate those rights or not.
In the case of Roe V wade the the unenumerated implied right of privacy in the Constitution to protect the individual against the state found that anti-abortion laws violated that right. The ninth makes it clear that I have rights well beyond those specified in the Bill of Rights. It clearly indicates the rights belong to the citizen as default. I don't have to wait for legislation to provide me that right.
I can point to any supreme Court decision that struck down a law on behalf of an unenumerated right and say "there's a legislative solution here". That's not how the system or rights work. The rights exist by default and the court determines if a law is in violation of those rights.
One does not need to go to the state to ask permission if they are allowed to perform an abortion. The state has to go to the court to ask permission if they are allowed to ban an abortion.

As for the fact that people voted for banning abortion is just bollocks and you should be better than that. But this is what happens when your argument is just a religious exercise not far off the Taliban who see women as property.
For decades conservatives have been a minority of the population but have managed parity through gerrymandering but also consistently higher turnout. Abortion was the piper's call for many. Liberals had causes, but none that really resonated with the veracity of abortion (healthcare and wealth inequality should have, but I digress). But now they do - restoring Roe v Wade.
Sure, the GOP can bang the drum about the importance of the midterms to protect this Supreme Court decision...but now the Dems can bang the drum about the need to win Congress by more than a Manchin-majority to restore women's rights. WI, PA, NC, FL all have GOP senate seats on the ballot that were polling as legitimate tight contests before the court pissed off a bunch of 18-30 year old women that were maybe gonna vote, but, yanno, probably gonna forget.
At best the GOP can hop to get equal turnout levels. Which, based on their percentage of the population at large, is likely a net negative. And for Joe, being the president that restored women's reproductive rights is a massive win that he wouldn't have otherwise gained.
