That seems like total bullshit, Fighters rely on USADA and the UFC to ensure they aren't fiighting PED users. How is that consenting to anything?

If you read the judgement, it's a case of a judge using spurious reasoning to nevertheless come to a sensible conclusion (which is how it often works).

There is no legitimate justification for why cheating to hurt your opponent via roids is different from cheating via other means, the judgement essentially says 'it's different because it just is'.

But I don't want fighters to be able to sue for roids.

The Court noted that doping is different than a fighter bringing loaded gloves to the ring or cheating by other means.
yes it is literally a different act. great job! really tricky argument for them to sustain. if the ufc did not take appropriate precautions to prevent this cheating, surely there is a case to answer.

This is the problem with the judgement, I should backtrack a bit on my previous post. I have no problem with a judge ruling that fighters accept the risk that their opponent might be doping.

But that's entirely different from them consenting to fighting a guy who has conspired with the promoter in odd to be given a free pass to dope.

You can't prove said conspiracy, goof.
My point was that Hunt's lawsuit was not simply about fighting a roided fighter, whether or not he they ultimately proved it, and that I would like a fighter to be able to sue in these particular circumstances if they could.

This is just one of a few times he admitted that he thinks brock is using steroids but doesn't care, he'll beat him anyway. Don't know about precedent and the implications for other fighters, but Mark hunt at least consented.

Court – Combat Sports Athletes Consent to Fight Doping Competitors
Court’s widely cited decision in Avila v. Citrus Community College District , a baseball batter claimed that the pitcher intentionally threw the pitch at his head, which he argued exceeded his assumption of risk.

Acknowledging that this pitch “is forbidden by the rules of baseball,” the court held that being hit by a pitcher, even intentionally, “is an inherent risk of baseball.”

So, although an “athlete does not assume the risk of a coparticipant’s intentional or reckless conduct‘totally outside the range of the ordinary activity involved in the sport,’” the pitcher’s intentional throw did not fall outside of this range.

Like that intentional throw, the fact that Lesnar was allegedly doping violated the bout rules established by UFC and the NAC but does not alone establish that his conduct exceeded the ordinary range of activity in an MMA fight. As Hunt’s own allegations demonstrate, doping is an unfortunately common issue in MMA and was a risk he perceived. And although he argues that doping empowered Lesnar to move faster and hit harder, Hunt doesn’t allege that Lesnar’s conduct during the bout was somehow atypical—such as throwing Hunt out of the octagon orusing “packed gloves” or a weapon. Nor does Hunt claim that his injuries exceeded those typical of an MMA bout.

And because all injuries have occured in MMA, up to and including death, there is no physical risk greater in a juiced fight than a non-juicing fight. As Tank Abbot showed, without the juice, a natural fighter just can't quite get a fighter out of the octagon like a juiced one.

There you have it. The line in the sand. No weapons or throwing out of the octagon. All other cheating inside the ring by way of illegal strikes, enhancement, etc. are a known risk that does not allow recourse. These are just intentional baseballs thrown at your head. And if someone has cheated before, you knew that was part of the game.

If you gotta fight an enabled juicer at least only sign contracts that get you paid if they have any traces or roids in system...don't leave it up to USADA...make it happen with a judge/lawyer approved contract with very strict wording
