Murder is a direct synonym or homicide. You're attempting to argue the legal definition of murder where the dictionary definition provides all of your answers.

You're also continuing to operate under the assumption she isn't being charged with murder.

Because that's manslaughter, not murder.
that's murder, as there is clearly 'malice aforethought'. Depending on the state, manslaughter may not be an option (2nd degree Murder or other charge), and different states have different definitions of 'aforethought'. But in some states if you did mean to hurt someone by your action, that's murder.
