Elijah Johnson, 21, 10115 Ballina Ave., was booked into East Baton Rouge Parish Prison Sunday on counts of mingling harmful substances and resisting an officer. His bail was set at $4,000.
A Baton Rouge Police Department lieutenant ordered a burger at 3:30 p.m. Sunday at a Dairy Queen, 3444 S. Sherwood Forest Blvd. Before eating, the officer looked at his burger and noticed what looked like spit on the top of his bun.
“The lieutenant stuck his finger into the substance attempting to determine what it was and verified the substance resembled saliva,” according to a police report.
The officer complained to a store manager, said Cpl. Don Coppola, a spokesman for the Baton Rouge Police Department.
A store surveillance video showed that Johnson grabbed a bun, walked off to the side, and, apparently thinking he was out of view, brought the burger up to his mouth briefly, walked back and then completed making the burger, Coppola said.
Upon questioning, Johnson initially denied spitting on the burger and gave a false name and date of birth — he has an outstanding warrant with the Baton Rouge Constable’s Office — but later admitted he suffers from several diseases, including herpes, Coppola said.
The saliva on the burger is being DNA tested to see if it matches Johnson, Coppola said.
