This is the country we live in. A man can't drink and drive because he's a little stir crazy. He can't be drunk and driving even if it's to have some positive interactions with homeless people? Shame on you America!

He was set up. He thought he was being healthy and drinking orange juice. Turns out it was a tainted drink. The gun was obviously planted.

Blood test is for abuse of other drugs...and even if you are taking too much of a prescription drug
I know this from family member who keeps doing this shit that Jon keeps doing

Yes breath is reliable and is all that is needed for charging and conviction of alcohol charges

I think his .16 was after a cool off period of at least an hour or so...probably was well above .2 when he was pulled over...big guy elite athlete like Jon metabolizes alcohol fairly fast

Breath is really relaible if administered right, but it often isn't.
That I don't know anything about.

I do know that a good DUI lawyer can do amazing things with seemingly easy convictions.

I think Jon should get some time to get a reality check and actually clean his act up for him and his kids, but I won't be surprised if he gets off scott free...He catches all the breaks and Dana probably got him the best of lawyers.

and also to never self incriminate or talk to the cops

Jon gave out Waay to much info...about driving and intention to drive...and should have no commented on the gun...it was one round short of full and likely has his prints on it, yet he claims he didn't know about it

hear in my state you are fucked if you refuse a breathalyzer.
What's the penalty? Up here the penalty is the same for refusal as it is for failing. The difference is you can go to trial and try to prove your innoncence if you refuse, but if you fail outright you're fucked because you've given them the required evidence.

Personally, I detest drunk driving, but the idea that you're required by law to provide evidence against yourself is craziness.
