I have had arrests and prosecutions without the full FST's. I articulated in my report why I didn't do them due to it being a blizzard and the roadside conditions. I will do HGN though, that's the biggest one, the eyes don't lie.

I did it in the back of an ambulance once after a guy rolled his truck during an ice storm while he was sitting on the stretcher. I just said hey let me look at your eyes real quick, he blew a .22.

I never took someone to jail for an OUI unless they were an asshole. If I knew there was somewhere they could go that was safe where someone could watch them, I would just cut them a summons and give them a ride home or have a family member pick them up from the intox location.
Yeah of course (that you dont need them). That isn't the point I was making. It isn't some win if you are otherwise impaired. But sober or drunk, they are only going to hurt you. Did you ever see a cop let someone go based on FSTs when they were already convinced enough to do them? Maybe. And the rest is consistent with what I thought about you--you are a cool dude.

Ever see the video of the kid who blew 0s, arrested, urine, nothing, and they still won't admit they were wrong?

He took the FSTs fine and cop just claimed he failed them because that is the point of them.

Edited to fix my memory.

He did a urine test not a blood test late.

I assume he was referring to the one at the jail rather than the roadside one. Typically, the officer offering you that test will explain the possible consequences of refusal.
Yes, it's during the Breathalyzer, there is a form that we fill out that goes directly to the BMV and their license is suspended immediately if they refuse to take it.

The only consequence I can think of for take taking FSTs would require a cop with a bad attitude (possibly due to the suspect), an incompetent DA, and a bad judge which could happen in a number of liberal cities. I think all states have a template for how to handle DUIs. If they go outside that, the judge better have a valid reason.

From what I've seen on body cam footage, the cop will typically take the suspect to a proper place to do the FSTs including the parking garage at the jail so they are inside and warm on a level surface though I think those instances are the ones where they are just strengthening the case since they already took them to the jail.

The FSTs can fix an otherwise bad arrest due to their subjectivity, the court may later find there was PC (it at least helps them down the line). No FSTs, they can only point to observations and your driving, and that is going to be hard if you were sober. If I get hauled in when sober, I dont want to lend them any help on PC later.

And if you do drink and it is a close call, you definitely dont want to help them build PC to get to the required test which is going to nail you.

Yeah doing them post arrest is super dumb. I've seen that too.
