The pickup, it was on him to stop, not swerve into the next lane because he wasn't paying attention to what was ahead in his lane.

The pickup truck, it's his responsibility to change lanes safely.

It was also a demonstration of a lack of defensive driving on the part of the rig driver. He should have see the situation unfolding in time to avoid the accident, but still not his fault.

Good point, personally my head is on a swivel all times checking mirrors/sides when driving, but can't fault him, it was such a quick lane change there was no time to react.

I agree on the first part. Disagree on the second. The rig driver left plenty of "safety cushion " in front. The pickup truck had plenty of time to see the stopped rig and slow down. The pickup truck didn't just see the rig in front and jerk of into the other lane. He waited till the last second to merge. The rig didn't hit him till half way up. The side of the pickup. Either way lawyers will be involved. The pickup truck driver will try to get paid. Sucks for the rig driver either way. Especially if he is a owner operator. That is my 2 cents anyways.

Pickup drivers fault
If the big rig is hauling a heavy load it’s not good to make any sudden fast stops even slowing down can jack knife a rig

too many people compare handling a rig same as a car or pickup not even close

Agreed. The pickup is at fault, but in my opinion defensive driving involves anticipating the fuck ups by other people. In this case it would have been nice if the rig driver was able to see the situation develop when the pickup failed.

Both drivers should have seen the stopped/slowed truck in the right lane. The pickup truck had the legal responsibility to change lanes safely, but the rig driver should have also seen the situation and said to himself "Self, that guy is going to need to move into this lane"

The rig driver is in the right, but he is in the right with a wrecked rig and potentially some injuries. With some defensive driving he would still be in the right, but on his merry way and no worse for wear.
