You get a gun that might also be a replica. A replica requires a permanent disabling and there are a variety of laws usually pertaining to them as well. They confirm its a working gun that has the firing pin reversed. They document both the before and after.

The DA would then look to either 1> make their case with disabled gun still breaks some law 2> suggest evidence tampering. The latter is possible in this case since the police didn't arrive to seize the guns at that time, but rather the gun was handed over to the defense attorney a month later. The former doesn't appear to apply to the law the way it is written and should likely be thrown out.

Regardless, that would have been an interesting precedent to determine. If you know your gun is unloaded, disabled, what law are you breaking?

Fucking scum doing this with no consequences. The family said the cops like always didn't do shit eventhough we're told blacks walking down the street get shot on sight by black hating cops. The family has to pay the fees for the damage because the stuff was rented. They have a gofundme though and have gotten lots of support...

Regarding tampering...

They will argue that it's really unlikely that she ran outside with a disabled pistol. But after breaking the law it's much more likely that she simply turned the firing pin around. The difference between that pistol working or not working is about 20 seconds worth of effort.
The pistol was not actually disabled permanently. It can be field stripped a part flipped 180° and put right back together. Can literally do it with no tools in about four or five motions.

Where did you read it was field stripped? How can they prove what time that happened exactly?

If I was defense I would argue what I felt was possible when I saw her poor discipline...that her husband knew she should not have a loaded gun in her hands in almost any situation other than save her own life self defense...and gave her the non functional visible threat...maybe she knew or maybe she didn't.

I have no inside information about the case.

If the mob can destroy at will and face zero charges then I don't think these folks deserve a felony...just my opinion, I only saw a photo and read two articles so far.

Upper in one closet and a lower and another. They're not together. Alone they can't do anything. But they can be put together quickly with no tools. And with that it's enough for possession and a felony.
