From what I understand you cannot sue an airline for flying commercial over your property, but you could have grounds if say a helicopter or small private plane is over your property without the proper permissions. You do own airpsace above your property and there are processes for approvals to be able to fly above homes. Airlines have this covered, its a necessary function of society to allow this, but private flights are different. If I understand it further, the FAA effectively has an easement in the airspaces they travel, they do not own it.
You're mistaken.

I live near a local/small airport and there is no permission asked for (nor granted) when small aircraft fly over suburban residences.

Further, I believe that drones 100% violate property laws. They fly too low, are too loud, and can be highly dangerous if control is lost and they crash. Provided this guy didnt violate local firearm discharge laws, he should be in the clear shooting one down. If say you are in some rural area where you can hunt off your back doorstep, shooting down a drone I would think would be tough to enforce in any lasting way.
While he also violated local gun laws, you're incorrect about the legality of shooting down drones.

As someone posted previously, drones are considered aircraft and treated just like planes and helicopters. People have done this before and they get fucked in court.

This dude will likely get fucked as well.

Should have kept his mouth shut when people asked him about it...
