I don't think something being done or not being done for a long time is a very good argument for doing it.
And I wouldn't consider something happening 150 years ago as "precedent". By definition, sure. It counts. But 150 years?

I'd be more concerned with this being the new norm. Now there is recent precedent, so as soon as a party has the ability they can just add however many justices they need to move the majority.

What the Republicans did was crooked. (Garland, Barrett)
What the Democrats are doing is crooked.

Lifetime appointments need to go away.
Should they be elected? Washington has proven they aren't responsible enough to handle it.

Yes it counts. And as I said it doubly counts given George Washingtons participation and the Republican politician common propensity for invoking the founding fathers and originalist arguments as a principal of conservative basis.

Suddenly the founding fathers don't count? Constitutional originalists mean to reinterpret the document and founding father intent this go around?

Hauler @Hauler and lest you missed My post above. I'm not even arguing in favor of the move.
I just simply see it as an extension of party focused politicking that has been pervasive for an extended period of time.

And I don't think even the conversation or the move destroys the institution in some unique way.

Rushed replacements after a death.

My point isn't that things are great. It's that acting like Biden adding justices would be a new harm to the court, versus all the previous congressional fuckery, is dramatic exacerbation.

It will completely erode public confidence in the neutrality of the court. Or are you convinced that surely the Republicans won't do the same thing when they achieve a simple majority in Congress, and eventually a despot won't use this simple lever to keep one party in power indefinitely.
