I'll find the link in a little.
News called home owner with house under construction.
Homeowner video ownder refused to share video with news.
When asked if the video showed Aubrey stealing, the homeowner responded "it shows him trespassing".

The video of the "robbery" at a construction site may be nothing more than him walking up to it while walking around his neighborhood.

Given that the homeowner took the time to state that crime and not mention he was stealing, vandalizing, etc. one can infer that those other things didn't occur on that video.

We will see what comes up, but the idea that there is video of him stealing from a construction site is questionable and seems to be built on a taking the old robbery stuff plus this fact and melding them together. I've seen no confirmation that is what the video shows.
Damn, there is certainly some fuckery afoot. I think most people who know me know I'm big on being able to defend yourself even using deadly force. Sadly this looks like a couple of inbred idiots tried to be Batman and Robin and killed a guy for something numerous people have done. I can't imagine shooting someone for looking around my house while it was being built. While it was being built there were numerous times I'd show up and people would be looking around.

He attacked. If he laid down and ended his crime spree he would just be in jail.

I'm not finding the whole article from yesterday but here some on CNN
CNN - Breaking News, Latest News and Videos

Greg McMichael told Glynn County police that Arbery was suspected in "several break-ins," but no such string of crimes was reported in the weeks before the shooting. Police have yet to clarify whether Arbery is accused of any crime at a home that was being built.

The owner of the under-construction home, who is listed as a victim in the police incident report, said his surveillance system captured at least four short clips of a man who appeared to be Arbery "coming onto his property" February 23. He declined to share them with CNN and spoke on the condition of anonymity because he says he's been receiving death threats.

The man walked by the garage and down to a dock on the Little Satilla River, the motion-triggered cameras show, according to the homeowner. Asked whether they showed the man stealing or committing any other crime, he said they show him "trespassing."

"I feel for the family, and this is a very bad situation," he said, before abruptly ending the Tuesday call after what sounded like a burst of gunshots that coincided with a CNN crew's arrival to the neighborhood.

Prior to Arbery's shooting, the man said in a second interview Wednesday, the cameras on three or four occasions captured someone walking on the property at night -- one time stealing $2,500 of fishing tackle from a boat in his garage -- but he could not identify the perpetrator.

He did not file a police report, he said, but called the incident "unnerving and unsettling."

Man, I feel for the guy who had his shit stolen, but it doesn't sound like there's any conclusive proof that the guy who got shot stole anything. It sounds like the guy who's house was previously burgled is now having a tough time due to no fault of his own either. This father and son combo sound like a bunch of trouble.

i don't think there's any reasonable way to say you made a positive ID on suspect from your yard when he went running past.

i'll even say that it doesn't really matter if he was actually on video stealing things in the neighborhood, the way that they went about trying to detain him was negligent and showed a callous disregard for life. They're ready to initiate a gunfight in a their neighborhood over a burglary suspect.

Arbery may be guilty of nothing more than using a construction site as a pass through to walk down a river that (by google maps satellite view) doesn't normally have an easy access in the neighborhood. Walked down to a dock and looked around. That's the only thing confirmed by the video owner so far.

While I agree with you, if it does show he was the one doing these things, and they did try to stop him, then IMO they are in the right despite what I may think of them personally. I know in Texas I can pull a gun to hold someone who is trespassing and/or stealing on my property. Obviously you don't go straight to the gun in this scenario unless they are actively trying to get into your home, imo. And if they were lawfully stopping him and they used gun then so be it.

BUT

If they have no first hand knowledge it was this gentleman than they are a couple of vigilantly morons who should be in jail.

Either way it's a sad loss of life.

Same Same. I don't think it was the intelligent or moral way to handle the situation, but it may well have been legal.

So you're saying he hasn't threatening the guy's life, then the guy attacked him.
i'm saying he sure isn't acting like someone who's worried that the person he's been chasing for 6 minutes was actually armed.

So the guy was running toward the driver's side where the son was, then the guy went to the passenger side, so the son went over to that side to cut him off. They were trying to stop him and arrest him.

Just because he had a gun in his hand does not mean he pointed it at the guy.

No I didn't. That's what the video owner said in the quoted text I linked you:

"Stop right there."

*guy gives up*
the guy who's been running from you for 6 minutes?

you think that by standing at port arms with a shotgun is going to make him lay down in the street?

2010 Georgia Code
TITLE 17 - CRIMINAL PROCEDURE
CHAPTER 4 - ARREST OF PERSONS
ARTICLE 4 - ARREST BY PRIVATE PERSONS
§ 17-4-60 - Grounds for arrest

O.C.G.A. 17-4-60 (2010)
17-4-60. Grounds for arrest

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.

Any lawyers want to unpack this?
Does this say there are two different scenarios and two different standards that one may do a citizens arrest?

I've been arrested without having a gun pointed at me. Only a complete fucking moron attacks a citizen holding a gun. Or a crazed criminal with a "mental health history"

Keep grasping and asking dumb questions repeatedly while weighing no evidence presented. You sir may fuck off
