people get massages, take naps, in prone position. Prone position in restraint is not dangerous or unique, happens all the time, nobody dies or gets harmed. It's not an immenently dangerous act, there's no evidence to support that it's 'highly likely' to cause death.

now we're on to The Cause of Death. If the intervening causes were the natural result of the defendant's acts, the officer is not the Cause of Death.

the consequence of the defendant's acts were the cause of death. Being involved in a crime, physically resisting, having heart disease, hypertension, toxicology (drugs) etc...those are the cause of death

It seems pretty straight forward to me, manslaughter through negligence .

Did they catch the scumbag who gave him the bag of dirty pills yet? He needs to be locked up as well.

Chauvin needs to go down for not rolling Floyd over and performing a wellness check.

I’d also charge the academy moron with the receding hairline with obstruction of justice, if he wasn’t there Floyd might still be alive, he was a complete cunt.

State wants to clarify that "Intent to apply unlawful force" is not correct requirement of the prosecution.

State wants "curative" statement from court, based on case law and statute.

difference is between whether Chauvin intended to make action or intended for the action to be unlawful.

Court denies but says it will turn over for rebuttal by restating instruction to disregard inaccurate interpretations of the law put forth by the attorneys.

Court also responds it's reasonable inference that Chauvin was following his training, allows Defense to put that argument forth.

State: "Verdict" means truth, not story or narrative. You're going to determine the truth. How safe is the prone position? none of those studies had someone with a knee on the neck. None measured O2 consumed. Excited delirium? no witness said that. Excited Delirium don't cry and grimace, they don't feel pain. Why are talking about ED that ain't Erectile Dysfunction?

State is pointing out all the gaps in the Defense "re-telling" of evidence, also now correcting the Defense interpretation of the Law and clarifying the law.

I'm really starting to see how cops walk on this stuff. If the police chief said Chauvin was acting within training, and the State was not trying so hard to get a conviction...easy for a guy like Chauvin to walk 9/10 times.

i don't find this argument compelling. Did he die with Chauvin or from Chauvin?

according to the law, Chauvin just has to be 'substantially responsible'...i think Mr. Chauvin has met that threshold

State: it's wrong to take this badge and use it as a license to abuse the public or not follow procedure or not render aid.

there's not two sides to that story.

If Chauvin wants to say he was scared, you have to recognize that there were 5 grown men with uniforms, guns, and radios. None called for backup. Chauvin had all the power. He had badge, guns, mace, backup, radio, all of it. WTF was he scared of with 3 HS kids and 2nd grader, an old guy who looks out for neighborhood, and a guy just asking to get George help.

You've met these people, they were on the stand. They're a bouquet of humanity, and they all came together because a stranger was suffering and they wanted to stop it. They were symbols of respecting the badge. You felt their anguish, torn between their love of life and their respect for the authority that the badge represents. They could have removed Mr Chauvin at any time. We wouldn't have to have this discussion. But these people called the police ON THE POLICE. They didn't deserve to be called unruly. They weren't. As if we can't see a man losing his life one breath at a time in front of them.
