He just contradicted himself. He says how can floyd die from asphyxiation if he had a 98% oxygen level and then says the paramedics started performing resuscitation and adding oxygen to Floyd's blood

Now we're at the two elements he'll dispute: were the actions authorized by the "reasonable officer" standard...not what he could/should of done...what did he know when he did what he did, was a reasonable police officer do the same thing.

All the officers agreed that an officer is entitled to take other factors beyond "what is known" when making their decision 'at the precise moment force was used.'

a reasonable officer wants to keep his partner safe, keep the scene secure, etc...

i just don't think this will land with the jury, especially after the prosecution hits back with any rebuttal.

Defense is highlighting the dynamic nature of the situation, using that as a rationale for the use of force as reasonable

Defense is drawing a line between what was known and what was not, at each point of the video record.
Chauvin walked up with two officers struggling with Floyd, who was actively resisting.

Defense is saying that Chauvin wasn't being callous, he was just being reasonable in comparing the suspects words and actions.

such as was Floyd actually unable to comply or simply being combative?

"3 MSP police offers weren't able to get him in the car"

OK - but they're on record saying that they didn't want to use the hobble because that would mean having to fill out Use of Force paperwork.

Just like in Indianapolis, lazy police lead to dead people.

eventually the defense is going to have to address that keeping your knee on a guy's neck for 5 minutes after he's blacked out isn't reasonable.

"so now we get in to the 9:29...that ignores the previous 16m of interaction. A reasonable police officer would include that previous 16m of interaction. Humans are unpredictable, nobody knows it better than the cops. People can go from fighting to compliant, compliant to fighting, in a second"

Defense is going to go with the officer stopped escalating when Floyd stopped escalating.
Focusing on the 30s of resistance that initiated the use of force...talks about the hobble as an 'escalation' opportunity by the officers.

Completely skips over the 'but we have to get a Supe down here' part of that discussion. LoL. Jury won't forget.

Officers called for EMS (non-emergency) because Floyd had a bloody lip...reasonable officers.
a minute later they're calling for EMS to get here faster. Reasonable police officer would expect EMS to be there in 3m. Help has been called.

reasonable officer being reasonable.

"if you can talk you can breathe" is what officers are taught (informal)...people say all kinds of shit when they don't want to get arrested.

reasonable officers recognize that and take in the entirety of the situation.

reasonable officers were worried about "excited delirium" and had EMS coming.

still not at that last 5 minutes of him not moving. that's what I want to see explained.

but try and imagine doing a BJJ round where you get top position and the guy doesn't move for 5m...wouldn't you be like "hey dude, you aight?"

reasonable officers would interpret a noxious seizure as active resistance....OK, now we're stretching...

now you have an officer saying "I think he's passed out". But reasonable police officers are aware of their surroundings, including the crowd.

"perspective and perception". Get ready for the big stretch

prosecutor opens this part by laying out that he can't see witnesses and jury.

COVID precautions impacted his ability to defend his client...nice appeal ground work there.

Defense is characterizing the crowd as a 'group in crisis' and a reasonable officer considers his department's training...except the training is for MOBS, and none of the elements (red face yelling/pacing/etc) were present.

"at the moment Floyd took his last breath, a guy stepped off the curb in aggressively, Chauvin took out his mace, and Genevive walked up from behind and startled him. That changed Chauvin's perception of what was happening. Reasonable officers don't perform CPR if it's not safe. Crowd was a hostile environment, you make mistakes and errors performing rescue in a hostile environment. Distraction can do harm to the patient"
