I guess you wouldn't be surprised if the jury found guilty of murder 2.
I would be because I didn't see an intentional killing take place.

But if they sit him up after 3m, he still dies?
Probably, yes. I'd go so far as to predict that if they had just left him in the police car he'd have died there too. Admittedly, it's been a while since I've sat down and watched the video, but from what I remember, Floyd's behavior was very similar to what I would expect from someone having an anxiety attack.

You should watch the part of closing statements where they go over conviction criteria. Intentional killing isn't required.

For murder 2? It either has to be intentional, or unintentional while committing a felony. Either of those strike me as a stretch given Floyd asked to be taken out of the car and put on the ground. In either case, the fact that there's even a discussion that could be had demonstrates that they overcharged him.

we're having a discussion because there seems to be a gap between what the judge/prosecutor/defense agree is the criteria for Murder2 and the criteria that you've stated.

Second-degree murder in Minnesota can be “intentional” or “unintentional,” which is the charge Chauvin faces, and is punishable by up to 40 years in prison if convicted. The second-degree murder charge requires prosecutors to prove Chauvin caused Floyd’s death while committing or trying to commit a felony — in this case, third-degree assault.

Third-degree murder would require a lower standard of proof than second-degree. To win a conviction, prosecutors would have to show only that Floyd’s death was caused by an act that was obviously dangerous, though not necessarily a felony. That would result in a maximum sentence of 25 years.

But there are caveats. Chauvin has no criminal history, which means he will probably end up serving about 12.5 years whether he is convicted of second- or third-degree murder.

Manslaughter, the least serious charge but also the one with the lowest burden of proof, means a maximum of just 10 years behind bars if convicted. The manslaughter charge has a lower bar, requiring proof that Chauvin caused Floyd’s death through negligence that created an unreasonable risk, and consciously took the chance of causing severe injury or death.

After reading @Splinty 's post I don't think there is. Murder 3 was a slam dunk.

Unless has Chauvin already plead guilty to 3rd degree assault?

My guess is that sentencing will be about a month later but that's simply based on a couple of youtube vids that I've seen

What about soldiers fighting in illegal wars? Them too?
I mean.....there was a period of time we were trying to send them to jail on a regular basis.

Here's one example I am personally aware of because we were all on the same MEU and did some work together.
