Wait, you are comparing the worst outcome of one thing (judge killed) versus a side effect of the worst outcome in the riot.Supreme Court judges are the ones who rule on constitutional matters. By killing a Trump appointed judge to replace him with a Biden appointed one is a literal attempt to alter how the American democratic system is supposed to function.
On the other hand, having Pence not certify the election results doesn't change the elections outcome. This has apparently been mentioned in the proceedings by Pence"s own team.
