Lmao. Don't the police ones have clear labels showing they are drones and why the fuck are they spying on crazy old men who clearly want to be left alone? Dude's gotta have a spotless record.
The whole federal charge nonsense needs to come to an end. Most drones are no more than expensive, glorified RC toys. And the reality is people do not want them hovering over their homes and/or property.
Gotta be smarter about drone hunting, imo.
In real estate you legally own the property down to the core of the earth and up to the atmosphere.
From what I understand you cannot sue an airline for flying commercial over your property, but you could have grounds if say a helicopter or small private plane is over your property without the proper permissions. You do own airpsace above your property and there are processes for approvals to be able to fly above homes. Airlines have this covered, its a necessary function of society to allow this, but private flights are different. If I understand it further, the FAA effectively has an easement in the airspaces they travel, they do not own it.
Further, I believe that drones 100% violate property laws. They fly too low, are too loud, and can be highly dangerous if control is lost and they crash. Provided this guy didnt violate local firearm discharge laws, he should be in the clear shooting one down. If say you are in some rural area where you can hunt off your back doorstep, shooting down a drone I would think would be tough to enforce in any lasting way.
There are limits but they're usually tied to safety depending on the situation. An airport can't start launching planes 10' over your house because it's not safe and the FAA would never allow it. Kinda the same with drones but the FAA would have to actually do their job and access the RemoteID logs to find the operator, if it even has RemoteID. They can be almost impossible to track down if the operator doesn't want to be found.
I was taking a leak in my backyard one evening when a drone swooped down out of nowhere making it obvious they were watching me whiz. I smiled and waved so now somebody out there has my pee tape. I'm in a now fly zone near an airport so the FAA may actually do something if I reported it but I also run my drone around here sometimes so I don't want to open that can of worms.

So walmart was doing mock deliveries to try and drum up business for their drone delivery service and this happened. I'm on the side of the old guy, if there is a drone within my curtilage that has no reason to be there I am taking it out. LEO can not even access your curtilage besides exigent circumstances without a warrant.
One of the facts that really pisses me off is ,for example, that if my friend wants to operate his drone and film us kayaking on the Buffalo River (NPS territory) he must get express written permission from the NPS. However, dick heads don’t have to obtain permission from property owners here (as far as I know) to fly over their homes and film.
Anyone remember the story from several years back where the guy shot one down with a shotgun, a guy was spying on his 16 year old sunbathing , as far as I remember the charges were dropped.

There is drones that hover around here(I live walking distance from the donuthouse/pd) but they hover incredibly high. Too high to pop unless you are a good shot. I usually see one when there's a reason for it to be around(cholo in foot pursuit). I couldn't imagine some weasely fuck like this one bothering me for being loud and/or shooting burnt beeQ smoke signals. That'd be asking for some not so OK Corral action for my Mario bros.
