Makes my blood boil.

I can't believe he got away with it. I have no idea why I decided to watch it considering Sex Chicken @Sex Chicken gave fair warning. I'm my own worst enemy. Talk about heartbreaking indeed.
Unfortunately with the way the laws are written, him getting off was the correct verdict
The man was warned not to make a mistake and he did which the officer can take as a threat because he had warned the person.
Now any normal person can use logic and tell that guy was no threat to anyone but because of our laws, asshole cops will continue to get away with murder

I do think there are time when a cop has to kill a person (one of my best friends was forced to kill a man when they shot at him, bullet missed his head by 6"), this was not one of those times

Well it's a bit of a strange one.
The guy shooting saw a risky movement that justified the shooting.

But the guy not shooting is the loud mouth escalating that we all agree worsened the situation to a probably unneeded end.

What statute in the law is there for the cop escalating?

When I first watched I didn't realize it was a different guy yelling and all. But knowing that the shooter is there in case the suspect goes for a weapon, I can't fully fault him for shooting. He wasn't the one escalating and playing Simon says with a drunk guy.

But where's the Justice for the loud mouth? For the training that said crawl like a dog? To drunkenly go against your own natural instinct to catch yourself in a fall?

I would usually feel sympathy for a cop who had to (or accidentally) used his weapon, but for this guy I don't. He showed his true colours in the video. He had no respect for those peoples lives. He was playing a game where he knew that if they fucked up his instructions then he could legally kill them. He held it over their heads and enjoyed it. The guy was crying, begging not to be shot, and telling him that he was confused. This cop was not scared for his life, nor did he feel threatened he was just playing his game with a sick detachment as if the people he was dealing with weren't human.

this happened just up the road from me. Lots of theories about the man and the woman, but she refused to give interviews to the prosecution or the defense. She may have been intimidated or threatened.
Do you mind sharing where it happened?
Did they release his name by chance?

Finally watched with sound.

In the moment, the cop was justified under the law. Guy reaches down to waist band (to pull up shorts?) And they shoot. He didn't follow their instructions. He got shot.



Now...
Sue the shit out of the department. How is that good training? Why wasn't he face down, legs crossed, hands flat out on ground assessed to be a low enough threat to approach and cuff? What is the point of having him undo all that to crawl towards them??

Supposedly the guys drinking. Lots of disturbances will involve drinking. Why are commands complicated enough to create the situation?



Cop's a power hungry ass. But I wouldn't convict or acquit on that.

Interestingly the cop was apparently fired later on for violating policy.

I'd be real curious to know if it is in fact department training to have the shooting victim act the way he did.

If the cops were acting as trained, the department needs to be held responsible for what is obviously a needlessly complicated escalation.

If not acting as trained, I can't understand how he could get acquitted after failing to deescalate the situation.
So glad he was let go

that's bullshit. that moment where he tried to pull his pants up didn't happen in a vacuum. There was context. The guy was crying and begging for his life. And this was a 'suspicion' call, the officers hadn't even seen a weapon.
Unfortunately we can all see the guy was no threat, the laws can't see that

The guy doing the ordering was an asshole and was in the wrong making it a game, because of the mistake from the person, the officer was justified in using force according to the law

I fucking hate that this is how it work

The officer in charge during a police situation at a Mesa hotel last year testified Tuesday that he, too, would have shot the unarmed suspect, Daniel Shaver of Texas, when the man did not obey orders to put his hands up.

Sgt. Charles Langley, who retired from the Mesa Police Department four months after the Jan. 18, 2016, shooting, testified in the murder trial of former Officer Philip “Mitch” Brailsford.

Brailsford, who was fired months after the shooting for unrelated issues, is charged with second-degree murder in the shooting of Shaver, 26, at a Mesa La Quinta Inn and Suites, where he was staying on a work-related trip.

If convicted, Brailsford could face 10 to 25 years in prison.

Brailsford's lawyer has asserted the officer shot Shaver during a confrontation in a hallway because it appeared Shaver was reaching for a weapon when raising his right hand toward his waist.


The prosecutor has said the shooting was unjustified, and through the course of the trial, she has noted that of the three other officers who had their firearms pointed at Shaver, only Brailsford shot.

In all, six officers arrived at La Quinta after a report of a man pointing a gun outside a fifth-floor window.

Sergeant: 'I thought we were going to get shot'
Langley told the 11-member jury Tuesday that he would have shot Shaver if Brailsford wasn’t in his line of fire.

“I thought we were going to get shot,” Langley said. “I thought I was going to get shot.”

Langley said because Shaver put his hand down twice and once behind his back, he thought Shaver may have been reaching for a gun.


Officers later found that Shaver was unarmed when he was shot but had a pellet gun inside his room that he kept with him as part of his job as a pest-control worker for his father-in-law's Texas-based company.

Footage of the shooting captured on two police officers' on-body cameras shows that Langley had yelled at Shaver to put his hands up after he came out of his room.

“For him to be safe, for us to be safe, there was one simple rule and that was to keep his hands in the air,” Langley said.

In the video, Shaver appeared confused by Langley's commands on what to do with his hands.

At one point in the video, Shaver puts his hands down and behind his back. Langley, who was in charge and the only one yelling out commands, quickly orders him to put them back in the air or else he would be shot, the video shows.

Brailsford fired his AR-15 rifle when Shaver raised his right hand after he had crawled on his hands and knees, the video shows.

Langley testified that he didn't know why Shaver seemed confused by his commands, especially when he had given similar commands to Monique Portillo, a woman Shaver met that night and had been in the room with him.

Langley is the guy shouting. No one looking at him. He retired quietly and gave the above statements.

I find him the largest problem here and emblematic of police interaction with citizens. He is the one escalating. He was the one in charge.

My last post kind of answers this, I didn't know it was two different people either but it makes sense
The guy yelling was playing a game and it's a good thing he got fired because he doesn't deserve to be a cop
The guy who shot wasn't playing games and followed the book

This could have been handled 1000x better but it really makes sense that the guy yelling was the highest ranking officer and I'll bet the guy who shot has only be on the force for max 5 years
The guy yelling got everybody amped up including the other cops for no damn reason and the guy yelling had everybody ready to pull at the first opportunity imo

If correct, he was encouraged to retire before this went to court

yep, the guy we got the picture of is the young guy who got amped up by the higher ranked officer and technically (the guy who shot) did follow the book
i think he got fired (although they say unrelated, i don't buy it) because the commander knew he would get off based on the law but anybody that had been trained properly and can properly use logic, wouldn't take that shot.
He reacted too quickly because of how stressful the sergent made the situation imo

we need to get the picture of Langley trending
