agreed. To bad you had to go there.
Glad you know everything about the case and Florida law. Can't believe your not practicing there since you know so much. Sorry I asked a question and offended your perfect knowledge of the case. Sorry that other posters agreed with me asking these questions and somehow offended you.

Let's say I'm in my yard and someone walks up on the sidewalk, steps onto my yard and tells me they're going to shoot/rob me. Can I shoot them dead in my yard before I see the gun in a SYG state?
if you have a reasonable fear of an actionable threat (seen gun before, person has attacked before, etc). It has to be an actionable threat for SD/Castle Doctrine/SYG to come in to play.

assuming an actionable threat and reasonable fear, you are covered under SYG or Castle Doctrine. Possibly SD laws depending on state.

lol wut? I answered questions with accurate information. You seem to be the only one offended.

and you don't have to be a practicing lawyer to be informed on issues that are relevant to your life and liberties.

You have posted your opinion so far with nothing to back it up but you saying it's true.
should be very easy to show that my opinions are wrong by posting contravening facts.

but you're just here for a pissing match.

No I was asking questions, you came in acting as a expert. Sorry I questioned your knowledge of Florida law since you live nowhere near that state but it's a legit question since you are posing as a lawyer now.

wow. the internet must be a scary place if you're unable to make determinations of fact among varying opinions without some sort of appeal to authority to fall back on.

Florida's 'stand your ground' statute

A person who is not engaged in an unlawful activity, and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

Summary - two guys arguing on county bus. Smaller guy seems to be an asshole. Bigger guy tries to physically intimidate smaller guy and then bigger guy is first to throw punches. Smaller guy pulls gun from waist and shoots bigger guy once in stomach (bigger guy is in hospital and expected to survive). Smaller guy goes on lam for 9 hours before turning himself in, is charged with attempted murder.

No idea if he had a CCWP (Florida requires one to carry a concealed weapon).

Can't find a video without local news assholes talking over it. Click the link for the unedited video.

Altercation on bus leads to shooting
I used to be so rght wing. But man. I fuckin hate guns nowadays. I bailed on grrm book signing bc I just got a bad feeling (since ei have some very very creepy stalkers on YouTube)

if someone is attacking you, or has articulated an actionable threat against your life (or property, depending on state), then Stand Your Ground does not come in to consideration. Your actions are covered by existing statutes on the lawful use of force.

It's only when you refuse to retreat from a potential threat that Stand Your Ground Laws are relevant.

Stand Your Ground is Castle Doctrine applied to public spaces

being actively attacked is covered under the lawful use of force, SYG explicitly removes any duty to retreat in those circumstances.
SYG basically prevents the State from considering the availability of retreat in pursuing charges, or using the availability of retreat in arguing for conviction/sentencing of the accused. It does not create a new affirmative defense.

You must have tried to find a actual law to support your claims and found out you have no clue what you are talking about.
from a guy who still hasn't read the statute, or any legal opinions on the statute

Laziest fake lawyer ever. I'm sure the law in Arizona and Florida are exactly the same and you Excel at both of them.
good point, it's impossible to be informed on anything that doesn't directly impact your state. You'd think that the law for any state would be freely available, and a person with critical thinking skills could review statutes (for the letter of the law) and case opinions (for the spirit of the law) and come to a conclusion in line with the commonly accepted interpretations of the law.

Maybe next year your mom will unlock all the child-protections on your internet service. Try being extra-good, and eating all your vegetables.

I am not the one making ridiculous claims with no proof.
