I believe they figure that every pregnancy has a heartbeat by 6 weeks, so that's where they drew the line.

Every visit to the obstetrician I had they gave me a gestational age to the day. It's probably an estimate but every record, sonogram, etc. has gestational age to the day printed on it.

Also if there was a specific traumatic event then there may be a police record etc.

I don't know if the story is true or not, but that one thing doesn't make it a fake story. It means it's possible no one thought to mess with the numbers and someone is taking advantage to score political points for sure - but I never underestimate people's ability to do things that don't make sense.
